No. 128; Section 3-1-3: descriptiveness refusal;
MULTI HOME COOKER for food or beverage processing machines and electric cookers;
Appeal No. 2014-11768 (December 2, 2014)

Bottom line: The Board found MULTI HOME COOKER is descriptive for food or beverage processing machines and electric cookers.

The applicant sought registration of MULTI HOME COOKER and its transliteration in katakana designating multi-purpose food or beverage processing machines and apparatus combined with electric cookers for household purposes in Class 7 and multi-purpose electric cookers for household purposes in Class 11.

The examiner refused to register the mark because the applied-for mark merely refers to multi-purpose cookers for home use, as “multi” means “many” and “home cooker” means “cooker for home use”.

The Board cited various references found on Internet that “multi cooker” in katakana is used to refer to multifunctional cooking appliances enabling to slow cook, roast, steam, bake, etc.  Further, “home” is used with name of appliances to indicate “home use”, such as “home bakery”, “home laundry” or “home theater”.  Accordingly, the Board found that the applied-for mark MULTI HOME COOKER refers to multi-purpose cookers for household purpose and merely describes the nature of the designated goods.

And so the Board affirmed the examiner’s refusal.
